Penstribe Publishing House – Terms and Conditions

Welcome to Penstribe Publishing House. By accessing or using our platform, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding with our services.

General Terms (Applicable to All Users)

  1. Acceptance of Terms

By creating an account or using any of the services provided on the Penstribe Publishing House platform, you agree to comply with these Terms and Conditions, as well as any updates we may introduce from time to time.

  1. Service Categories

Penstribe Publishing House offers two primary service categories:

  1. Platform Publishing Services – For authors who upload and sell their completed books directly on our platform.
  2. Professional Publishing Services – For authors who hire our team to provide professional publishing services including editing, cover design, formatting, marketing, and other related services through our automated publishing dashboard.
  3. Content Restrictions (All Users)

Authors are prohibited from publishing or submitting for publication the following types of content: a. Plagiarized material or content that infringes on copyright laws. b. Explicit or offensive material that violates community standards. c. Content promoting hate speech, violence, or illegal activities. d. Content that violates any applicable laws or regulations.

Failure to adhere to these restrictions may result in the removal of your content, suspension of services, and account termination.

  1. Data Protection and Confidentiality (All Users)
  2. All manuscript content and personal information provided will be treated with strict confidentiality. b. We implement appropriate security measures to protect your data and intellectual property. c. Team members working on your project will be bound by confidentiality agreements. d. We will not share, sell, or distribute your content without explicit written permission.
  3. Account Termination and Suspension (All Users)
  4. Authors can terminate their account at any time by providing written notice. b. Penstribe Publishing House reserves the right to suspend or terminate any account that violates these terms or engages in fraudulent or illegal activities. c. Upon account termination, you retain rights to all completed work and deliverables.
  5. Limitation of Liability (All Users)
  6. Penstribe Publishing House’s liability is limited to the amount paid for services rendered. b. We are not liable for any indirect, consequential, or punitive damages. c. While we strive to ensure a secure platform and quality services, authors are responsible for protecting their account credentials and reporting any suspicious activities.
  7. Governing Law and Jurisdiction (All Users)

These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from the use of the platform or services shall be resolved under Nigerian law, with jurisdiction in Nigerian courts.

PART A: PLATFORM PUBLISHING SERVICES

Terms for Authors Uploading Books Directly to Our Platform

A1. Author’s Rights and Responsibilities

  1. You retain full rights to the content you create or publish on the Penstribe Publishing platform.
  2. You are solely responsible for the originality and legality of your content. Penstribe Publishing House is not liable for any disputes regarding copyright, plagiarism, or intellectual property claims.
  3. It is your responsibility to ensure your content does not infringe on the rights of others or violate any applicable laws.

A2. Publishing Process

  1. Authors can upload their books directly using the Author’s Dashboard.
  2. All uploaded books will first be available on the website but will be reviewed and approved to meet our standards within 24 hours.
  3. Once approved, the book will be fully available and permitted on the website for sale.
  4. Authors can track sales and earnings through their dashboard in real-time.

A3. Revenue Structure

  1. For every book sale made on the Penstribe Publishing platform, a 10% fee will be deducted by Penstribe Publishing House as a platform service charge.
  2. The remaining 90% of the sale amount will be credited to the author’s account.
  3. Authors are responsible for ensuring their payment details are accurate and up-to-date in the Author’s Dashboard.
  4. Authors can request a withdrawal of their earnings anytime they choose, and payouts will be processed within 24 hours of the request.

A4. Refund Policy for Platform Sales

All sales made on the Penstribe Publishing platform are considered final. Refunds will not be issued for digital products unless under exceptional circumstances as determined by Penstribe Publishing House.

A5. Platform Usage Fees

  1. Registration and basic platform publishing are free of charge.
  2. Optional promotional services and additional features may incur separate charges.

A6. Dispute Resolution for Platform Sales

Any disputes between authors and buyers will be reviewed by the Penstribe team. The platform’s decision on such matters will be final.

A7. Marketing and Promotion for Platform Authors

  1. Penstribe Publishing House may feature your book in promotional campaigns to increase visibility.
  2. Authors can opt for paid promotional services for additional marketing support.

PART B: PROFESSIONAL PUBLISHING SERVICES

Terms for Authors Using Our Automated Publishing Platform and Professional Services

B1. Author’s Rights and Responsibilities

  1. You retain full rights to the content you create or publish through our professional publishing services.
  2. You are solely responsible for the originality and legality of your content. Penstribe Publishing House is not liable for any disputes regarding copyright, plagiarism, or intellectual property claims.
  3. FINAL DRAFT REQUIREMENT: Every manuscript that will be shared with the team to work on for publishing MUST be a final draft. On no circumstances will any addition to the manuscript be accepted more than ONCE.
  4. Once a manuscript is submitted for publishing, we will review it for any pending resources and the client can only provide these pending resources ONCE, after which there is no other addition to the manuscript that will be accepted whether for free or paid service.
  5. Hence, you must ensure that your manuscript that you are submitting is the FINAL draft.
  6. You must provide accurate and complete information about your manuscript and requirements.
  7. You are responsible for providing source materials in the required format and quality. h. Any delays caused by incomplete or incorrect information provided by you may affect project timelines.
  8. PROJECT TIMELINES: Our system has been programmed to give the exact project timelines for all projects based on the combination of services chosen. We are strictly bounded by the project timelines. There is no provision for timeline reductions, not even with payment.

B2. Service Selection and Payment

  1. Professional publishing services are no longer offered as packages. Every author will now select all the services they want from our book publishing service pool and receive tailored pricing.
  2. Service fees are expected to be 100% payment on the platform before the project begins, but 60% is the minimum permitted for installment payment and the remaining 40% must be paid before the book will be fully delivered.
  3. Failure to meet payment obligations may result in project suspension until payments are current.

B3. Automated Dashboard and Project Management

  1. All official communication regarding professional services will be conducted through the automated dashboard system and email when necessary.
  2. Authors can track project status, communicate directly with assigned team members, and review deliverables through the automated dashboard.
  3. Response times for communications will be within 24 hours during business days.
  4. Authors are expected to respond to requests for information or feedback within reasonable timeframes to avoid project delays.
  5. Emergency support may be available for urgent matters at additional cost.

B4. Service Delivery and Timelines

  1. Project timelines will be automatically communicated clearly by the system and seen on the dashboard before service commencement.
  2. We will provide regular updates on project progress through your dashboard and direct communication channels.
  3. Revision requests must be submitted within the specified timeframe and scope outlined in your chosen services.
  4. All deliverables will be provided in the formats specified in your chosen services.

B5. Service Scope and Revisions

  1. You are only given 2 revision permissions for any and every service you choose in your book project.
  2. Any revision more than 2 will incur additional charges.
  3. Major scope changes after project commencement may require additional fees and timeline adjustments.

B6. Intellectual Property for Professional Services

  1. Upon full payment, you retain complete ownership of all work products created under our professional publishing services.
  2. All ISBNs purchased through our services will be registered in your name, ensuring you maintain full publishing rights.
  3. Design files, edited manuscripts, and other deliverables become your property upon project completion and full payment.

B7. Revenue Structure for Professional Services

  1. Service fees are separate from platform commission and are paid directly for the publishing services rendered.
  2. Books published through our professional services and subsequently sold on our platform are subject to the standard 10% platform fee.

B8. Refund and Cancellation Policy for Professional Services

  1. Full Refund: Available within 24 hours of payment if no work has commenced. That is, if the “status” of the project has not been changed to “in progress”.
  2. Partial Refund: After work has begun (status becomes “in progress”), refunds will be calculated based on work completed and resources allocated.
  3. No Refund: Once deliverables have been provided and approved, or if project is more than 50% complete.
  4. Cancellation requests must be submitted in writing through your dashboard or official communication channels (hello@penstribepublishing.com).
  5. POST-PUBLICATION POLICY: On no occasion will a book that has been completed and published be re-edited, re-designed, or re-formatted for any reason. Once a book is fully delivered in e-book, paperback or hardcopy, no free revision is permitted after 1 week of publishing. 2-3 weeks requires extra charges to be determined by the publishing house, and any book published after 4 weeks cannot be revisited again except in the case of a new edition of the book.

B9. Quality Guarantee and Dispute Resolution

  1. We guarantee that all professional services will meet industry standards and the specifications outlined in your chosen services.
  2. If deliverables do not meet the agreed-upon standards, we will provide corrections at no additional cost.
  3. For professional services disputes, we offer a mediation process to resolve issues before considering termination or refunds.

B10. Marketing and Portfolio Usage

  1. We may use completed projects as portfolio examples and case studies with your permission.
  2. Authors can opt for additional paid promotional services for enhanced marketing support.

B11. Force Majeure and Service Interruptions

  1. Penstribe Publishing House is not liable for delays or failures in service delivery due to circumstances beyond our control, including but not limited to natural disasters, internet outages, or government regulations.
  2. In such cases, project timelines may be extended accordingly, and clients will be notified promptly.

Final Provisions

Modifications to Terms and Conditions

Penstribe Publishing House reserves the right to modify these terms at any time. Users will be notified of significant changes via email and dashboard notifications. Continued use of the platform after such modifications will constitute acceptance of the new terms.

Payout Policy (All Revenue-Generating Services)

  1. Payouts will be made to authors’ accounts after deducting applicable platform fees. b. Authors can request withdrawals anytime, and payments will be processed within 24 hours of the request. c. The platform reserves the right to withhold payments temporarily in cases of suspected fraudulent activities, unresolved disputes, or incomplete service obligations.

Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Penstribe Publishing House regarding the use of our platform and services, superseding any prior agreements or understandings.

For Platform Publishing Services: By proceeding to upload your book, you specifically acknowledge that you have read and accept the terms outlined in Part A of these Terms and Conditions.

For Professional Publishing Services: By proceeding to payment, you specifically acknowledge that you have read and accept the service-specific terms outlined in Part B of these Terms and Conditions.
